Terms and Conditions

The Mobile application, the Site (www.wakalu.com) and the information and services offered on these platforms to you are subject to the following Terms of Use. The Mobile application and the Site will be collectively referred to as the "Platforms".

You acknowledge that by accessing and using our Platforms, you have read, understood and agree to be bound by these Terms of Use. If at any time you do not agree with the Terms of Use, you must immediately cease your use of our Platforms.

WHO WE ARE & DESCRIPTION OF OUR SERVICES

We, Wakalu Sdn. Bhd. of 347-V, Tingkat Pemancar, 11700 Gelugor, Pulau Pinang, license you to use:

Wakalu provides users a platform to track their salary from time to time and access a portion of their earned salary ("earned salary access") based on their completed work days alongside additional features. This service is provided and available to you via employers registered with Wakalu only. Besides additional information required by yourself upon registration, additional information is also provided by your employer (read more about this in our Privacy Policy) that is required for our services to be provided.

USER REGISTRATION

Upon your employers registration, we will provide you with a Username and Password. The Password can be changed after your first login into the Platforms. You are then required to register with Wakalu directly. You agree and acknowledge to keep your password confidential and will be responsible for all use of your account and password.

If you believe that either your credentials or a device that you use to access the Platforms has been lost or stolen, that someone is using your account without your permission, or that an unauthorized transaction has occurred, you must notify us immediately at wtinquiry@wakalu.com

USER REPRESENTATIONS

By using the Platforms, you represent and warrant that (1) all registration information you submit will be true, accurate, current and complete. (2) you will maintain the accuracy of such information and promptly update such registration information as necessary (3) you have the legal capacity and you agree to comply with these items (4) you will not access the Platforms through automated or non-human means, whether through a bot, script or otherwise (5) you will not use the Platforms for any illegal or unauthorised purpose (6) you will not use the Site in any lawful manner, for any unlawful purposes, or in any manner inconsistent with these terms Wakalu assumes all actions made in your account is made or authorized by you. As such, you are expected to take full responsibility of these and protect your information. We will attempt to undo any unintended actions when contacted but cannot guarantee the issue will be resolved especially if it is beyond our control.

RESPONSIBILITY OF EMPLOYER

By agreeing to this Terms of Use, you are agreeing for your employer to deduct the sum amount of your withdrawals for that month from Wakalu prior to paying your salary for the month. All Wakalu withdrawals will be observed as a company advance and as such will constitute a payment of a proportion of your salary ahead of time.

TERMINATION

If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Platforms.

Wakalu also reserves the right to terminate, delay, or suspend your access to and use of our platforms if we believe there has been fraudulent or suspicious activity related to your Wakalu account.

INTELLECTUAL PROPERTY RIGHTS

Wakalu owns the software used by the Platforms and the intellectual property rights to the Platforms' contents. You are not entitled to copy, use, publish, promote, integrate, combine our software, content or brand without our express written permission to do so. Any unlawful use or any of the aforementioned actions will constitute a material infringement of our intellectual property rights.

You shall not use any electronic communication feature in the website for any purpose that is unlawful, tortuous, abusive, and intrusive on another's privacy, harassing, libelous, defamatory, embarrassing, obscene or threatening. Wakalu reserves the right to file the appropriate criminal and civil complaints and cause the prosecution of violators under the law.

USE OF PERSONAL DATA

We only use any personal data that we collect through your use of the Platforms in the ways set out in our Privacy Policy.

DISCLAIMER

All materials and information provided in the Platforms are provided "as is" without warranty of any kind, either express or implied. Specifically, Wakalu does not make any warranties or representations about the accuracy or completeness of the material provided. In addition, this Terms of Use may be revised by Wakalu from time to time without prior notice. You will be alerted if any major changes occur. By continuing to use the Platforms, you are bound by the most current version of the Terms of Use.

LIABILITY & INDEMNITY

Wakalu and its partners, affiliates, directors, officers and employees shall not be held liable for any loss, damage, liability or expense incurred or suffered which are claimed to result from the use of our Platforms, under no circumstances.

You also agree to hold all above mentioned parties free and harmless from any liability arising from any loss or damage in all instances mentioned in the previous sections of this Terms of Use and especially in the following instances:

  1. The conduct of any user on our Platforms.
  2. Delays on the use of our Platforms due to factors beyond our control.
  3. Delayed or inaccurate information received due to failure or disruption of the communications used by Wakalu to provide your services.
  4. Loss or damage caused by fraudulent activities resulting from the theft or unauthorised disclosure of your Login information.

GOVERNING LAW AND JURISDICTION

These terms are governed by Malaysia and the exclusive jurisdiction of the Malaysian courts.
